Nebraska employees who are injured on the job by an accident or contract an occupational disease are entitled to workers’ compensation benefits. Virtually all employers in Nebraska are required by law to have workers’ compensation coverage for their injured workers. It is not necessary to show that your employer was negligent to recover benefits and only recourse against the employer is through the worker’s compensation system. However, any third party negligence can give rise to an action against a non-employer.
Employees are entitled to medical benefits, wage loss benefits and vocational rehabilitation benefits for compensable injuries. Temporary total disability payments are due on the 8th calendar day of disability due to an injury and if the disability lasts six weeks or more, the first seven days are also payable. The amount of the benefits are two-thirds of the employees average weekly wage subject to a minimum and maximum each week. Permanent Partial Disability benefits for wage loss are also due an injured worker for either a scheduled member injury or body as a whole injury. Death benefits are also payable to a widow(er) or minor child.
